How Trademark Registration Works

Step 1
Search of logo / brand
The government trade marks journal is checked for any matching mark, so the application is not rejected early for a conflict.

Filing of application
Once the mark is confirmed as unique, the application is filed with the Trade Marks Registry. Filing takes a minimum of 3 days.

Application number
After filing you receive an application number and can start using the ™ symbol with your mark.

Step 4
Registration
If there is no objection, the mark is registered in about a year. You receive the registration certificate and can use the ® symbol.
Timelines are indicative. Registration depends on examination, any objection or opposition, and the decision of the Trade Marks Registry.

No. Court and tribunal outcomes depend on the facts, evidence and the decision of the court. Our advocates will explain your options and the likely process honestly.
Can you send or reply to a legal notice?
Yes. The panel can draft a legal notice for you or help you reply to one you have received. Share the notice and supporting documents at our office.
I received an auction notice from another lender. Can you help?
Yes. Our gold loan settlement service can help you release your gold, and the panel can advise on the notice if needed. Act quickly — notices usually carry a deadline.
Can you help register a trademark, copyright or patent?
Yes. Trademark, copyright, patent, design and logo registrations are handled with our IP partner, BDS Legal Services. A trademark search is done first, so the application is not rejected early for a conflict with an existing mark.
When can I use the ™ and ® symbols?
You can use ™ once your trademark application is filed and you have the application number. The ® symbol can be used only after the mark is registered and you receive the registration certificate, usually about a year later if there is no objection.
